Charter Rental Agreement

This Charter Rental Agreement ("Agreement") is between Coast to Cactus Party Bus ("Operator") and the individual or entity booking a charter ("Renter"). By submitting a reservation and paying the deposit, Renter agrees to the following.
1. The Charter
Operator will provide a licensed and insured party bus with a professional chauffeur for the dates, times, and route specified in the booking confirmation. Capacity is limited to 20 passengers.
2. Renter Responsibilities
- Renter is the responsible party for the entire group and must be present for the duration of the charter.
- Renter is liable for the conduct of all guests and for any damage or excessive cleaning caused by the group.
- Renter must provide an accurate guest count, pickup/drop-off addresses, and itinerary at least 48 hours before the trip.
3. Alcohol & BYOB
- Alcohol consumption is permitted only when 100% of passengers are 21 or older.
- The chauffeur may request photo ID at any time. Misrepresenting passenger ages voids alcohol privileges and may end the trip without refund.
- Operator does not sell or supply alcohol.
- No alcohol may be consumed within view of the chauffeur compartment or in violation of any state or local law.
4. Prohibited Conduct
- No smoking or vaping of any substance, including cannabis.
- No illegal drugs of any kind.
- No weapons.
- No standing or seat-jumping while the vehicle is in motion.
- No interference with the chauffeur, the controls, or emergency equipment.
The chauffeur has sole authority to terminate the charter without refund if these rules are violated.
5. Damage, Cleaning & Overtime
- Routine cleanup (light trash, incidental spills): included.
- Excessive cleaning (vomit, broken glass, bodily fluids, smoke odor): $250 flat fee.
- Equipment damage (broken seats, speakers, LEDs, screens, dance pole): billed at repair or replacement cost.
- Overtime: $150 per hour, prorated by the half-hour, charged for time beyond the booked end time.
Renter authorizes Operator to charge the payment method on file for any of the above, with photo documentation provided.
6. Walk-Through
The chauffeur conducts a brief pre- and post-trip walk-through with Renter and photographs the vehicle. Damage or cleaning fees are based on the difference between these states.
7. Right to Refuse Service
Operator may refuse to board any passenger who appears intoxicated to the point of safety risk, who refuses ID verification when requested, or whose conduct threatens the safety of the group.
8. Force Majeure
Neither party is liable for delays or failures due to events beyond reasonable control (severe weather, road closures, civil unrest, mechanical failure of partner vehicles). In such cases Operator will rebook the charter or provide a refund at its discretion.
9. Insurance
Operator carries commercial auto liability insurance meeting or exceeding all federal and state requirements for chartered passenger service. Renter is responsible for any losses not covered by Operator's policy that arise from passenger conduct.
10. Assumption of Risk
Renter and guests acknowledge that party-bus charters involve a moving vehicle and voluntarily assume the inherent risks. Renter releases Operator from claims arising from passenger conduct, BYOB consumption, or failure to follow chauffeur instructions.
11. Entire Agreement
This Agreement, together with the booking confirmation and the Terms of Service, is the entire agreement between the parties and supersedes prior discussions.
